vBulletin^TM Enterprise Translator Plugin (vBET^TM) is a copyrighted work of authorship and is also protected under applicable database laws. SIMPLE Podbielski Michał retains ownership of vBET^TM and any copies of it, regardless of the form in which the copies may exist. This license is not a sale of the original vBET^TM or any copies.

Note: SIMPLE Podbielski Michał (author, creator and owner of vBET^TM) is not committed with Jelsoft Enterprises Limited, author of vBulletin^TM. vBulletin^TM is a registered trademark of Jelsoft Enterprises Limited and it is a web forum software. vBET^TM is plugin to vBulletin^TM and it cannot be used without vBulletin^TM.

Please read this entire license agreement fully before using vBET^TM. This license covers installation/usage of vBET^TM in version 3.0.0 and higher (including series 3.x, 4.x and 5.x). By installing/using vBET^TM on your server, you agree to the following terms and conditions of this license, which is legal agreement between you (either an individual or any corporate entity which employs you or which you represent) and SIMPLE Podbielski Michał. If you do not agree to the terms of this license, you may not use vBET^TM.

Note: vBET^TM is using 3rd party translation providers (translation APIs). Using vBET^TM you are also bound by Terms of Use from ALL translation/detection APIs which you will use (it is configurable). Actually supported translation/detection APIs: Google, Microsoft®, Yandex , SDL Language Cloud , DetectLanguage , IBM Watson (IBM Cloud terms) and Apertium

Terms of usage

vBET^TM 3.0.0 and higher (including series 3.x, 4.x and 5.x) is NOT a free software and it is required to buy license to get right to use it. In case of any questions please contact us by: contact@vbenterprisetranslator.com
Paying fee for license, you get from SIMPLE Podbielski Michał non-exclusive license to use vBET^TM on one installation of a licensed copy of vBulletin^TM. vBET^TM license is a lifetime license - it means that after buying it you have right to use vBET^TM as long as you want, but access to free updates is restricted to 365 days period, from date of license purchase. After that period for additional fee you can buy license renewal to get access to updates for next 365 days. Each license is bounded to one domain and get you right to use vBET^TM only on domain registered for this license. For each installed instance of vBET^TM, a separate license is required.
Modifications and redistribution in whole or significant parts of vBET^TM code are prohibited.
You may not rent, lease, sublicense, sell, assign, pledge, transfer or otherwise dispose of the vBET^TM in any form, on a temporary or permanent basis, without the prior written permission of SIMPLE Podbielski Michał.
You must submit the URL where you are using (or plan to use) each vBET^TM installation. You can submit the URL by vBET^TM portal.
You undertake to not to use vBET^TM for any illegal purposes and shall comply with all applicable legislation.
All vBET^TM copyright notices must remain unchanged in all files.
You are NOT allowed to remove vBET^TM credit link, or use vBET^TM in Branding Free version (BF) unless you buy separate "Branding Free" license. Each "Branding Free" license gives you right to remove credit link from one installation of vBET^TM, or use one installation of vBET^TM in Branding Free version (BF).
Technical support to vBET^TM is provided via vBET^TM forum located at http://www.vbenterprisetranslator.com/forum/. SIMPLE Podbielski Michał reserves right to not support expired licenses. Also reserves right to mark old vBET^TM versions as deprecated and stop supporting it. In such case users of deprecated versions will have to update to not-deprecated version in order to get support.

Anty-piracy and breaking terms responsibility

SIMPLE Podbielski Michał reserves the right to inspect from time to time does terms of license are respected (including existence of credit link). Such inspection will not collect any data about your users or server and its only goal is to fight with software piracy. Such inspections can be made automatically by robots, or manually by SIMPLE Podbielski Michał staff.
SIMPLE Podbielski Michał reserve right to include inside vBET^TM code for robots checking license integrity. It can include making connections and transmission of data between your server and vBET^TM portal. Note that such transfer will include ONLY data required to validate your vBET^TM license - it means: your forum URL and license key.
If any of the terms of this license are violated:
- SIMPLE Podbielski Michał reserves the right to revoke vBET^TM license at any time. If that happens you must uninstall vBET^TM from your forum and delete all vBET^TM files and all copies. You have 2 days to do that since license was revoked. In case of license revoke, you have no right to any refunds. You will be notified about license revoking by message send to your account in vBET^TM portal.
- You will be charged for amount not less than $5000.00 per license violation in case if your forum will be found to running unauthorized vBET^TM instance or if vBET^TM credit link was removed without "Branding Free" license or for other license violations. Those are to cover cost of piracy detection, pay enforcement, legal fees and also to make you feel that instead of software piracy it is better to buy legal license for vBET^TM.

Disclaimer of Warranty

vBET^TM and the accompanying files are sold "As Is" and without warranties as to performance of merchantability or any other warranted whether expressed or implied.
vBET^TM is using EXTERNAL translation services (translation APIs). Since version 4.4.0 and 3.5.0 vBET^TM is able to use many translation/detection APIs (actually supported: Google, Microsoft®, Yandex, SDL Language Cloud, DetectLanguage, IBM Watson and Apertium API). You must be allowed to use supported translation APIs which you configure to be used by vBET. SIMPLE Podbielski Michał gives you no refunds in case if your forum is blocked/banned or limited in any other way to any of used Translation API, even in case if some/all supported translation APIs will be closed. You will have no right to any refund if your forum access to any Translation API will be limited in any way during usage of vBET^TM 3.x/4.x/5.x. SIMPLE Podbieski Michał is not responsible in any way for any of used Translation APIs results or it's performance and accessibility.
You are responsible to assure that vBET^TM works with your vBulletin^TM version and on your server. SIMPLE Podbielski Michał takes no responsibility and gives no refunds in case if you fail to install/run vBET^TM on vBulletin^TM version other that officially described as compatible, or because of other modifications incompability, or of lack of any necessary PHP library, or lack/malfunction of any required components of your web hosting or server environment, or because of wrong vBET^TM installation or configuration.
SIMPLE Podbielski Michał is not responsible for any possible conflicts with other plugins/modifications to vBulletin^TM. You can use vBET^TM with any other modification on your own risk. SIMPLE Podbielski Michał will take the effort to make vBET^TM compatible with major vBulletin^TM plugins/modifications according to possibilities, but without any guarantee that it will remain compatible with modifications new releases.
SIMPLE Podbielski Michał cannot be held responsible and accepts no liability for any failure in translation, but we will make our best effort to fix any issues related to vBET^TM code ass soon as possible.
You must assume entire risk of using vBET^TM. SIMPLE Podbielski Michał will not be responsible for any damages, including lost profits, lost savings, loss of data or any indirect, special, incidental or consequential damages arising out of the use or inability to use vBET^TM.
Defects are natural occurrence in software development life cycle, and if any is found in vBET^TM, then you (NOT SIMPLE Podbielski Michał) assume the entire cost of repair and service. Still SIMPLE Podbielski Michał will take effort to try to fix defects in future vBET^TM releases.

License modifications

SIMPLE Podbielski Michał reserves the right to modify license agreement at any time.
Failure of receiving notification about license changes doesn't make those changes invalid.

Governing law

This agreement shall be governed by the Laws of Poland. Any action in regard to this license agreement or arising out of its terms and conditions shall be instituted and litigated in Nysa in Poland. Each of the parties consents to jurisdiction in such Court and agrees that service of process as provided by the states and rules of civil procedures of Poland shall be sufficient.
